Prescott Cleared of Civil Claims Amid Ongoing Legal Battle
In a significant development, a Collin County judge has exonerated Dak Prescott of all civil claims stemming from sexual assault allegations. This decision arrives months after Dallas police opted not to proceed with any charges against the Dallas Cowboys quarterback due to insufficient evidence.
The allegations against Prescott date back to 2017. His accuser initially demanded a staggering $100 million to keep the matter out of law enforcement's hands. In March, the accuser officially lodged a complaint with the Dallas Police Department. Prescott responded by filing both a civil lawsuit and a criminal report against the accuser, claiming extortion.
Amidst this legal turbulence, the accuser’s legal strategy saw an unexpected shift. In April, her attorney withdrew the lawsuit filed in Dallas County only to initiate a similar suit in Collin County. However, Judge Angela Tucker dismissed these claims in June, bolstering Prescott's legal position.
Levi G. McCathern, Prescott’s attorney, expressed unwavering confidence in the justice system’s ability to uncover the truth. "As we knew they would, they found nothing in their extensive exploration of the facts that would support a criminal prosecution," McCathern stated. He condemned the accuser’s actions, asserting, "The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak."
McCathern further highlighted the detrimental impact these false claims can have on genuine victims of sexual assault. "These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them," he remarked.
Amid the fierce legal battle, Prescott has maintained his innocence, standing firm in the face of allegations. "I know the truth, I'm confident in what we filed, very confident in what we filed," Prescott commented.
In response to the allegations, Prescott also emphasized his empathy towards survivors of sexual assault, especially as a new father. "Mr. Prescott -- a new father to a baby girl -- has great empathy for survivors of sexual assault," McCathern conveyed.
While the civil claims have been quashed, the legal fight is far from over. Prescott is pursuing his own civil lawsuit, seeking over $1 million in damages and citing extortion. "We are confident that at the end of law enforcement's investigation into the extortion case that they will find the accuser and her attorneys just as guilty as Dak is innocent," McCathern noted.
Despite the recent legal victories, the accuser’s motion for a "non-suit without prejudice" leaves open the possibility of her re-filing the case in Dallas County. This move adds another layer of complexity to the legal what proceedings that continue to unfold.
Prescott’s legal team remains vigilant, ensuring that false accusations do not tarnish his reputation. "To be clear, Mr. Prescott has never engaged in any nonconsensual, sexual conduct with anyone. Lies hurt. Especially, malicious lies. We will not allow the Defendant and her legal team to profit from this attempt to extort millions from Mr. Prescott," McCathern declared.
As the legal process plays out, Prescott's focus on his career remains unwavering. Entering the final season of a four-year, $160 million contract in 2024, the star quarterback's on-field performance continues to be a cornerstone for the Cowboys. The ongoing legal battles, while significant, have not distracted Prescott from his professional responsibilities.
With a hearing scheduled for September to determine if further legal action against the accuser is warranted, the resolution of this high-profile case remains to be seen. For now, Prescott stands vindicated in the eyes of the law, ready to move past the allegations that have loomed over him for years.
